Job Summary: We are seeking an experienced and versatile Generalist Lawyer to join our legal team. The ideal applicant will be knowledgeable in various legal disciplines and able to provide professional legal advice and representation on a wide range of issues. As a Generalist Lawyer, you will handle cases, advise clients, and ensure legal compliance. The ideal candidate can assist clients in understanding these principles, allowing them to negotiate a fair agreement while minimizing the number and severity of legal problems they face. The ideal applicant would have a comprehensive understanding of many legal disciplines and be able to provide excellent advice and counsel on a wide range of legal issues.
Duties and Responsibilities: a. Regulatory Compliance and Policies :
Advice on compliance with other relevant codes, regulations, and statutes. Stay informed of national and local regulations impacting the real estate and construction industry. Conduct thorough title searches to verify property ownership and identify any encumbrances or title defects. Resolve title issues to ensure a clear and marketable title for the client. Help in developing, updating, and reviewing employee handbooks and HR policies to ensure they comply with labor laws and regulations. Assist in navigating legal aspects of employee terminations, ensuring compliance with employment laws, and drafting severance agreements when necessary. Helps HR navigate complex labor laws to ensure compliance and avoid legal issues. Help develop training programs to ensure HR staff and employees are educated about relevant laws, policies, and compliance requirements. Ensuring compliance with data protection laws, drafting privacy policies, and addressing issues to related data breaches. Assist in developing and reviewing internal policies to ensure they align with legal standards and mitigate potential legal risks. Assist in designing, implementing, and managing employee benefits programs ensuring compliance with applicable laws and regulations. Oversee and facilitate real estate closings, ensuring all legal requirements are met. Coordinate the transfer of funds, resolve any outstanding issues, and ensure proper documentation execution. b. Contract Drafting and Review: Risk assessment involves identifying legal, financial, and intellectual property risks in real estate transactions, advising management on insurance coverage, and reviewing bonds to protect company interests. Collaborating with Operations Department workers, resolving intellectual property concerns making recommendations to management, and negotiating bonds to safeguard firm interests. Ensure the legal validity and compliance of all documents with relevant laws and regulations. Review, draft, and negotiate Operations contracts, subcontracts, and other legal documents to ensure that they align with the company's interests and comply with relevant laws and regulations. Provide legal advice on contractual rights and obligations to support the operations team. Assist in drafting and reviewing employment contracts to ensure legal compliance, clarity, and protection of both the employer and employee rights. Help in contract drafting, reviewing and negotiating contracts for offices and dorms to ensure legal terms are clear and protect the company's interest. c. Due Diligence: Conduct legal due diligence for incoming and current operations projects, including reviewing land use issues, titles, and potential legal obstacles. Conducting and overseeing workplace investigations into employee misconduct or other workplace issues, ensuring a fair and legally sound process. Represent clients in real estate-related litigation, such as disputes over property boundaries, contract breaches, or landlord-tenant conflicts. Negotiate settlements and mediate disputes to avoid litigation when possible. Collaborate with external counsel as needed for specialized legal matters. Prepare and present the company's case to external legal counsel. Assist in the preparation of legal documents, evidence gathering, and courtroom presentations. Maintain detailed records of all communications, negotiations, and agreements related to dispute resolution. Draft, settlement agreements or other legal documents to formalize resolutions, reached through negotiation. Assess the feasibility and necessity of litigation in more complex or intractable disputes. d. Preparation of Litigation: Represent clients in real estate-related litigation, such as disputes over property boundaries, contract breaches, or landlord-tenant conflicts. Negotiate settlements and mediate disputes to avoid litigation when possible. Collaborate with external counsel as needed for specialized legal matters. Prepare and present the company's case to external legal counsel. Assist in the preparation of legal documents, evidence gathering, and courtroom presentations. Maintain detailed records of all communications, negotiations, and agreements related to dispute resolution. Draft, settlement agreements or other legal documents to formalize resolutions, reached through negotiation. Assess the feasibility and necessity of litigation in more complex or intractable disputes. e. Dispute Resolution: Engage in direct negotiations with the involved parties to reach an amicable resolution. Develop negotiation strategies that align with the company's objectives while maintaining positive relationships with stakeholders. Assist in the resolution of operation disputes through negotiation, mediation, arbitration, or litigation when necessary. Develop and execute legal strategies. Facilitate media on sessions when disputes cannot be resolved through direct negotiations. Criteria: Bachelor's degree in Law or related field. Advantageous for MA or BSc in Business Administration. Proven work experience in Generalist, Real Estate, Lawyer, and Legal Advisor roles. Valid law license. Knowledge of real estate laws and regulations. Understanding of litigation, property management, and sales transactions. Understanding of corporate governance, labor laws, and taxation. IPO experience. Strong analytical, critical thinking, time management, and organizational skills. High professional ethics and integrity. Sound judgment and excellent communication skills.
